{"id":21057,"date":"2024-11-19T16:08:34","date_gmt":"2024-11-19T06:08:34","guid":{"rendered":"https:\/\/woodcentral.com.au\/?p=21057"},"modified":"2024-11-19T16:33:06","modified_gmt":"2024-11-19T06:33:06","slug":"no-risk-pathway-eu-postpones-the-eudr-until-december-2025","status":"publish","type":"post","link":"https:\/\/woodcentral.com.au\/no-risk-pathway-eu-postpones-the-eudr-until-december-2025\/","title":{"rendered":"&#8216;No Risk&#8217; Pathway: EU Postpones the EUDR Until December 2025"},"content":{"rendered":"\n<p>The European Commission has confirmed that the EUDR will be delayed until at least December 2025 <a href=\"https:\/\/www.euractiv.com\/section\/agriculture-food\/news\/eudr-parliament-backs-no-risk-group-trade-partners-accuse-eu-of-protectionism\/\">&#8220;so that companies can comply with the law that ensures products sold in the EU are not sourced from deforested lands.&#8221;<\/a><\/p>\n\n\n\n<p>Wood Central understands that the law will take effect on 30 December 2025 for large companies and 30 June 2026 for micro- and small enterprises &#8211; publishing <a href=\"https:\/\/green-business.ec.europa.eu\/publications\/guidance-eu-deforestation-regulation_en\" target=\"_blank\" rel=\"noreferrer noopener\">updated guidance<\/a>&nbsp;to help stakeholders navigate changes to the regulations.<\/p>\n\n\n\n<p>&#8220;In response to concerns raised by EU member states, non-EU countries, traders and operators that they would not be able to comply with the rules if applied as of the end of 2024, the Commission proposed postponing the applicate date of the deforestation regulation by one year,&#8221; the EU said in a statement. <\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>&#8220;The European parliament agreed to this postponement with 371 votes to 240, with 30 absentments.&#8221;<\/p><\/blockquote><\/figure>\n\n\n\n<h6 class=\"wp-block-heading\">Low, Medium, High Risk and now &#8216;No Risk&#8217; categories&#8230;<\/h6>\n\n\n\n<p><b>Key changes include a  new &#8220;no risk&#8221; country category &#8211; <\/b> which, according to the EU, is defined as countries with &#8220;stable or increasing forest area development&#8221;, with countries facing &#8220;significantly less stringent requirements&#8221; as compared to higher-risk countries.  This new category has been slammed by environmental groups, which claim that it &#8220;undermines the regulation&#8217;s effectiveness,&#8221; arguing that the &#8220;no risk&#8221; loophole could open the way for resource laundering, where products from high-risk countries are re-routed through no-risk nations. <\/p>\n\n\n\n<p>The decision comes after EU trade officials had reiterated that the previous deadlines would be honoured during WTO negotiations, <a href=\"https:\/\/woodcentral.com.au\/no-delay-eu-stands-firm-on-eudr-deadline-despite-wto-criticism\" target=\"_blank\" rel=\"noreferrer noopener\">citing a &#8220;commitment to legal certainty.&#8221;<\/a> That is, despite WTO Director-General Ngozi Okonjo-Iweala and <a href=\"https:\/\/woodcentral.com.au\/germany-seeks-urgent-delay-is-the-eudr-on-the-brink-of-collapse\/\" target=\"_blank\" rel=\"noreferrer noopener\">German Chancellor Olaf Scholz pressuring Ursula von der Leyen<\/a>, the European Commission&#8217;s president (and former German Finance Minister), to retract her commitment to the EUDR.<\/p>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>&#8220;Ursula von der Leyen might as well have wielded the chainsaw herself,&#8221; Greenpeace said. &#8220;People in Europe don&#8217;t want deforestation products, but that&#8217;s what this will give them.&#8221;<\/p><\/blockquote><\/figure>\n\n\n\n<p>According to the WWF\u2014which published research last year showing that the EU was the second largest consumer market for deforested products\u2014the new rules cast doubt on the Commission&#8217;s commitment to delivering on the EU&#8217;s Green Deal. (Copyright: Greenpeace)\n<\/figcaption><\/figure>\n\n\n\n<p>In response, Manfred Weber, president of the centre-right European People&#8217;s Party (EPP), <a target=\"_blank\" href=\"https:\/\/www.politico.eu\/article\/manfred-weber-ursula-von-der-leyen-europe-deforestation-law-walkback\/\" rel=\"noreferrer noopener\">immediately took credit for rolling back the regulation<\/a>\u2014described by Peter Liese, EPP&#8217;s spokesperson on environmental issues \u2014<a target=\"_blank\" href=\"https:\/\/woodcentral.com.au\/no-delay-eu-vows-to-push-on-with-eudr-despite-chaos\" rel=\"noreferrer noopener\">as a &#8220;bureaucratic monster&#8221; run by &#8220;the greens, socialists, leftists and\u2026French Liberals.&#8221;<\/a><\/p>\n\n\n\n<p>&#8220;I am pleased that [Commission President] Ursula von der Leyen has followed my initiative,&#8221; he said in a&nbsp;<a href=\"https:\/\/x.com\/EPPGroup\/status\/1841451611136069747\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>&nbsp;on X last month, with Mr Weber&#8217;s stance firming after the EU&#8217;s June elections saw several green-friendly groups lose ground at the polls.<\/p>\n\n\n\n<p>&#8220;Together with our farmers, we are protecting the environment &amp; avoiding a bureaucratic monster,&#8221; Weber said of the EUDR. (Photo Credit: EPA-EFE\/RONALD WITTEK)<br><br><\/figcaption><\/figure>\n\n\n\n<p>Wood Central has reported that governments, particularly in developing countries, have complained that the EU is imposing its values and laws on their domestic industry\u2014<a target=\"_blank\" href=\"https:\/\/woodcentral.com.au\/india-balks-at-eudr-barrier-new-rules-could-derail-124b-fta-deal\/\" rel=\"noreferrer noopener\">especially as the deforestation law came in tandem with a carbon border tariff that the EU plans to place on heavy industrial imports like cement, iron, and steel.<\/a><\/p>\n\n\n\n<p>In a statement, the Commission acknowledged that &#8220;several global partners have repeatedly expressed concerns about their state of preparedness&#8221; and that European companies&#8217; preparation was &#8220;also uneven.&#8221;<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">What are the key changes now expected?<\/h6>\n\n\n\n<p>In conjunction with the new deadline, the European Commission&#8217;s additional guidance clarifies key terms, including &#8220;forest degradation&#8221; and &#8220;operator,&#8221; provides updates on traceability obligations and penalties, and offers practical scenarios to help businesses navigate compliance.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button is-style-outline is-style-outline--1\"><a class=\"wp-block-button__link wp-element-button\" href=\"https:\/\/green-business.ec.europa.eu\/publications\/guidance-eu-deforestation-regulation_en\">Download the new guidance document <\/a><\/div>\n<\/div>\n\n\n\n<p>The Commission will also introduce a country benchmarking system to classify countries as low, standard, or high risk. This system will help streamline operators&#8217; due diligence processes. Most countries are expected to be classified as low risk, allowing efforts to focus on areas where deforestation is most severe.<\/p>\n\n\n\n<p>In addition, the Commission is enhancing international cooperation to support a just and inclusive transition to deforestation-free supply chains, particularly in countries where the regulation could have far-reaching economic impacts. New training, support tools, and an IT system for due diligence statements are set to be launched by the end of the year.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\">How the EUDR will work<\/h6>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The regulation will assign regions within countries inside and outside the EU a low, standard, or high-risk level associated with deforestation and forest degradation.<\/li>\n\n\n\n<li>This risk classification will guide the obligations of various operators and the authorities in member states to perform inspections and controls. Consequently, this will streamline monitoring for high-risk regions and simplify due diligence processes for low-risk&nbsp;regions.<\/li>\n\n\n\n<li>Authorities responsible for these areas must inspect 9% of operators and traders dealing with products from high-risk regions, 3% from standard-risk areas, and 1% from low-risk regions.
